A dramatic rise in legal searches by passengers injured in car accidents reveals widespread confusion about compensation rights, with online queries up by over 600% in just three years.
Between 2022 and July 2025, searches for terms such as ‘car crash passenger claim’ and other related phrases have soared by 608% in the UK, highlighting a sharp increase in people seeking clarity after road traffic incidents.
Despite the surge in interest, it remains a common misconception that passengers can’t make a claim – a myth that legal experts at RTA Law, who carried out the research, say urgently needs busting.
Speaking on the findings, RTA Law’s Euan Baikie explained why passengers should not forget their rights:
“Passengers are in a very strong position when it comes to making a claim, as they’re almost always considered the innocent party. There are a few key things people should know:
- You can claim no matter who was at fault: Whether it was the driver of the car you were in or another motorist, their insurance should cover you.
- Uninsured or hit-and-run drivers aren’t a barrier: You can still claim through the Motor Insurers’ Bureau.
- Compensation covers more than just injuries: Passengers can recover costs for medical treatment, rehabilitation, lost earnings, and even travel expenses.
- There are time limits: Generally, three years from the date of the accident, although for children this starts from their 18th birthday.
“The only situations where compensation might be reduced are if you weren’t wearing a seatbelt or knowingly got into a car with a driver who was unfit to drive, for example under the influence of alcohol or drugs.”
RTA Law’s Euan outlined the crucial steps to take after an accident:
“Taking the right steps immediately after a collision can also make all the difference.
- Check for injuries and get medical help: Call 999 if necessary, even for what seem like minor injuries.
- Stay safe at the scene: Move away from traffic if you can.
- Exchange details: Make sure all driver and insurance information is collected.
- Gather evidence: Photos and witness details are vital for any future claim.
- Report the accident: Ensure it’s properly logged with the police.
- Seek legal advice quickly: Passengers are almost always entitled to claim compensation.”
